Terms of Service

HomeWise AI is a professional platform intended exclusively for licensed real estate agents, brokers, and real estate agencies ("Professionals"). By signing up, you represent and warrant that:

• You are at least 18 years of age.
• You are a licensed real estate professional or represent a licensed real estate agency in your jurisdiction.
• All information you provide during registration is accurate, current, and complete.
• You have the legal authority to enter into these Terms on behalf of yourself or your agency.

We reserve the right to suspend or terminate any account that we determine, in our sole discretion, does not meet these eligibility requirements.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@homewise.ai if you suspect unauthorized access.

Each account represents a single agency or individual agent. You may not share accounts, sell access, or allow third parties to use your account on your behalf without our prior written consent.

You agree to use HomeWise AI only for lawful purposes and in accordance with these Terms. You agree not to:

• Post false, misleading, or fraudulent property listings.
• Collect or harvest personal data from buyers or leads without proper disclosure and consent.
• Use the platform to send spam, unsolicited communications, or engage in any form of harassment.
• Attempt to circumvent, disable, or interfere with security features of the platform.
• Reverse-engineer, decompile, or extract the underlying AI models or proprietary technology.
• Resell or sublicense access to the platform to other parties.
• Violate any applicable real estate laws, fair housing regulations, or professional licensing requirements.

HomeWise AI uses advanced AI technology to power listing chat, lead qualification, follow-up drafting, and other features. You acknowledge that:

• AI responses are generated automatically and may occasionally be inaccurate or incomplete.
• You are solely responsible for reviewing all AI-generated content before using it with clients.
• HomeWise AI does not guarantee that any AI feature will generate a specific outcome (e.g., leads closed, tours booked).
• You must not use AI-generated content in any way that violates fair housing laws or other applicable regulations.

HomeWise AI offers a free tier and paid subscription plans (Pro, Agency). Paid plans are billed monthly in advance. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

We reserve the right to change pricing with 30 days' notice. Continued use of the platform after a price change constitutes acceptance of the new pricing. We may suspend access to paid features if payment fails and is not resolved within 7 days of notice.

Free tier usage is subject to monthly message limits and feature restrictions as described on the pricing page. We may adjust free tier limits at any time with reasonable notice.

You retain ownership of all property listings, lead data, and other content you submit to the platform ("Your Content"). By submitting Your Content, you grant HomeWise AI a limited, non-exclusive, worldwide license to store, process, and display Your Content solely to provide the services.

You are responsible for ensuring that Your Content does not infringe any third-party rights, violate any laws, or misrepresent any property or transaction.

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform you consent to the data practices described in the Privacy Policy.

The HomeWise AI platform, including its design, software, AI models, trademarks, and all related intellectual property, is owned by HomeWise AI and its licensors. These Terms do not grant you any rights in our intellectual property except as explicitly stated.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI RESPONSES WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEWISE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) $100 USD.

You may cancel your account at any time from your dashboard settings. We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the platform ceases immediately.

We may retain certain data for legal, compliance, or dispute resolution purposes after account termination, as described in our Privacy Policy.

These Terms are governed by the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before the changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
