Terms of Service

HomeWise AI is an Institutional Intelligence Platform serving the following user communities:

• Real Estate Professionals — licensed agents, brokers, and agencies who use the platform to manage leads, AI-assisted communication, market intelligence, and buyer relationships.
• Homebuyers — individuals using the HomeWise buyer portal, Decision Room, and AI-assisted property discovery and recommendation tools.
• Learning Center Visitors — individuals accessing HomeWise educational content, with or without a registered account.
• Advertising Partners — businesses placing Featured Listings, Partner Ads, or other promotional content on the platform.
• Mortgage Partners — mortgage lenders and brokers participating in the HomeWise Mortgage Lead Widget and associated referral programs.

Sections 07–09 contain terms specific to Professionals, Advertising Partners, and Mortgage Partners. All other sections apply to every user of the platform.

All users must be at least 18 years of age.

Real Estate Professionals must hold a valid real estate license in their jurisdiction, or represent a licensed real estate agency. By creating a professional account, you represent that all registration information is accurate, current, and complete, and that you have the legal authority to enter into these Terms on behalf of yourself or your agency.

Buyers may create an account to access the buyer portal and personalized AI features. By creating a buyer account, you represent that you are entering into these Terms for lawful personal, non-commercial purposes.

Advertising and Mortgage Partners must represent a legitimate business entity and comply with all applicable advertising, lending, and consumer protection laws. Partner access is governed by a supplemental Partner Agreement in addition to these Terms.

We reserve the right to suspend or terminate any account that does not meet applicable eligibility requirements, as determined in our sole discretion.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at legal@homewise.estate if you suspect unauthorized access or a security breach.

Professional accounts represent a single agency or individual professional. You may not share accounts, resell access, or allow unauthorized third parties to use your account without our prior written consent. Buyer accounts are personal and non-transferable. Partner accounts are restricted to the registered business entity. No account type may be transferred, sold, or assigned to another person or entity.

You agree to use HomeWise AI only for lawful purposes and in accordance with these Terms. You agree not to:

• Post false, misleading, or fraudulent property listings, advertising content, or mortgage product information.
• Collect or harvest personal data from other users without proper disclosure and consent.
• Use the platform to send spam, unsolicited communications, or engage in any form of harassment or unlawful discrimination.
• Attempt to circumvent, disable, or interfere with security features or access controls of the platform.
• Reverse-engineer, decompile, or extract the underlying AI models or proprietary technology.
• Resell or sublicense access to the platform or any platform data to other parties.
• Violate any applicable real estate laws, fair housing regulations, mortgage lending laws, professional licensing requirements, or consumer protection laws.
• Use the platform in any way that could harm, deceive, or unfairly disadvantage buyers, sellers, renters, or any other platform users.

HomeWise AI operates multiple AI systems across the platform. All users acknowledge that:

• AI responses are generated automatically and may occasionally be inaccurate, incomplete, or inapplicable to your specific situation.
• AI-generated content — including property recommendations, market analysis, buyer insights, and marketing drafts — is for informational purposes only and does not constitute legal, financial, real estate, or mortgage advice.
• You are solely responsible for reviewing all AI-generated content before relying on it, sharing it with clients, or distributing it.
• HomeWise AI does not guarantee that any AI feature will produce a specific outcome, including leads closed, tours booked, or mortgage approvals.
• AI-generated content must not be used in any way that violates fair housing laws, lending regulations, or other applicable laws.

AI Systems on this Platform

• Aria — conversational AI that assists buyers with property discovery and homebuying education. Registered buyers benefit from cross-session memory that helps Aria personalize responses over time.
• Aura — market intelligence AI that draws on real estate market data to surface trends and insights for professionals and buyers alike.
• Romy — buyer recommendation AI used within the Decision Room to help buyers evaluate and compare properties. Romy's output reflects buyer preferences and available data — it is not an endorsement of any property.
• Nova — marketing AI used by real estate professionals to draft newsletters, social content, and campaign materials. Professionals are responsible for reviewing and approving all Nova-generated content before distribution.

The HomeWise Learning Center provides free educational content on homebuying, mortgages, market analysis, and real estate. Introductory courses are accessible without a registered account. Advanced courses require newsletter subscription to unlock.

All Learning Center content is for educational purposes only. It does not constitute legal, financial, or real estate advice. HomeWise AI does not guarantee that Learning Center content is current, complete, or applicable in all jurisdictions.

Newsletter subscribers may unsubscribe at any time. Subscription data is collected and handled in accordance with our Privacy Policy. We may send educational and platform update emails to subscribers. We will never sell subscriber contact information to third parties.

Applies to Real Estate Professionals

HomeWise AI offers a free tier and paid subscription plans for real estate professionals. Paid plans are billed monthly in advance. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

We reserve the right to change pricing with 30 days' notice. Continued use of the platform after a price change constitutes acceptance of the new pricing. We may suspend access to paid features if payment fails and is not resolved within 7 days of notice.

Free tier usage is subject to monthly message limits and feature restrictions as described on the pricing page. We may adjust free tier limits at any time with reasonable notice.

Applies to Advertising Partners

Advertising Partners using Featured Listings or Partner Ads on the HomeWise platform agree that:

• All advertised content is accurate, non-deceptive, and compliant with applicable advertising laws and fair housing regulations.
• HomeWise AI reserves the right to review, approve, reject, or remove any advertising content that violates these Terms or our advertising standards, without prior notice.
• Partner Ad placements are subject to availability and the terms of the supplemental Partner Agreement.
• HomeWise AI does not guarantee placement position, impression volume, click volume, or outcomes from advertising.
• Advertising fees are non-refundable unless explicitly stated otherwise in the Partner Agreement.

Applies to Mortgage Partners

Mortgage Partners participating in the HomeWise Mortgage Lead Widget agree that:

• All mortgage products, rates, and disclosures presented to buyers through the Widget are accurate, current, and compliant with applicable lending laws, including RESPA, TILA, and applicable state mortgage advertising requirements.
• Leads delivered through the Mortgage Lead Widget are provided for lawful mortgage origination purposes only. Leads may not be resold, transferred, or used for any purpose other than responding to the buyer's expressed interest.
• HomeWise AI is a technology platform — not a mortgage lender, broker, or advisor. We do not guarantee lead quality, volume, conversion rates, or compliance with any specific lending outcome.
• Mortgage Partners are solely responsible for all buyer communications and for compliance with all applicable mortgage lending, advertising, and consumer protection regulations.

You retain ownership of all property listings, lead data, buyer information, and other content you submit to the platform (“Your Content”). By submitting Your Content, you grant HomeWise AI a limited, non-exclusive, worldwide license to store, process, and display Your Content solely for the purpose of providing the services described in these Terms.

You are responsible for ensuring that Your Content does not infringe any third-party rights, violate any laws, or misrepresent any property, transaction, or financial product.

For Buyer accounts: preferences, saved properties, and Decision Room activity belong to you. HomeWise AI may use this data to improve AI recommendations within your account, as described in our Privacy Policy. We do not sell buyer data to third parties.

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform you consent to the data practices described in the Privacy Policy.

Data collection practices vary across user types. Professionals, Buyers, Advertising Partners, and Mortgage Partners each have specific data handling practices described in the Privacy Policy. We encourage all users to read the Privacy Policy in full.

HomeWise AI's Home Setup feature uses Google's Address Validation service to standardize and confirm home addresses you enter. When you use this feature, the address you enter is sent to Google for this purpose. Google's use of this information is governed by Google's Privacy Policy and the Google Maps Platform Terms of Service.

Google's address validation results are used solely to help you confirm your home's address during setup. They do not constitute, and are never used as, proof or verification of legal property ownership. HomeWise AI's own attribution to Google Maps appears wherever these results are shown to you, consistent with Google's requirements.

The HomeWise AI platform — including its design, software, AI models, trademarks, Knowledge Assets, and all related intellectual property — is owned by HomeWise AI and its licensors. These Terms do not grant you any rights in our intellectual property except as explicitly stated herein.

Learning Center content, including all courses, lessons, and educational materials, is owned by HomeWise AI. You may not reproduce, redistribute, resell, or create derivative works from Learning Center content without our prior written consent.

The platform is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or that AI responses, market data, property information, or mortgage rates presented on the platform will be accurate or complete.

HomeWise AI is not a real estate broker, mortgage lender, financial advisor, or legal advisor. Nothing on this platform constitutes real estate, mortgage, financial, or legal advice. Buyers, sellers, and borrowers should seek qualified professional advice before making any real estate or financial decision.

To the maximum extent permitted by law, HomeWise AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim or (b) $100 USD.

You may cancel your account at any time from your dashboard settings. We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent or deceptive activity, violate fair housing or consumer protection laws, or if required by applicable law. Upon termination, your right to use the platform ceases immediately.

We may retain certain data for legal, compliance, or dispute resolution purposes after account termination, as described in our Privacy Policy. Partner Agreements may contain additional termination provisions that supplement this section.

These Terms are governed by the laws of the United States, without regard to conflict of law provisions. Any disputes arising out of or relating to these Terms or the platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.

We may update these Terms from time to time to reflect changes in the platform, our user communities, applicable law, or our operational practices. We will notify registered users of material changes by email or by posting a notice on the platform at least 14 days before the changes take effect.

Continued use of the platform after the effective date of updated Terms constitutes acceptance of the revised Terms. If you do not agree with any changes, you must stop using the platform before the effective date.
